Oldham Council has successfully prosecuted an unlicensed scrap metal carrier.

On September 29 last year a Police Community Support Officer (PCSO) on foot patrol responded to a call on Cedar Crescent , Chadderton.

The PCSO found a man breaking up fridges with a hammer and a van laden with scrap metals.

Due to his actions, and the waste being carried in the vehicle, the man’s details were taken down and the matter was reported to the Council.

An Enforcement Officer subsequently issued Stephen Rushton, of Stanhope Way, Failsworth with a Notice to produce his Waste Carriers’ Licence.

When he failed to produce the licence a Fixed Penalty Notice of £300, reduced to £200 if paid within 10 days, was issued.

The Council launched legal proceedings when the fine was not paid.

On March 29 at Oldham Magistrates’ Court Rushton was found guilty in his absence of failing to produce his waste carriers’ licence

He was fined £600 plus £300 costs.

Elaine McLean , Oldham ’s Council’s Executive Director for Economy, Place and Skills, said: “All those involved in the scrap metal trade must be licensed as rogue traders and metal thieves give those who operate within the law a bad name.

“Carrying waste illegally is a criminal act and we will not allow people to flout the law.”
