A Cowbridge pub has been fined £3,000 for six food hygiene offences, after an investigation by the Vale council’s environmental health team.

Cuisine Inns Ltd, trading as the Barley Mow Inn, in Craig Penllyn, failed a routine food hygiene inspection on 6 March 2012.

An environmental health officer served a Hygiene Improvement Notice with a compliance date of 29 March 2012, ordering a thorough deep clean of the premises.

But when officers visited the pub on 30 March 2012, they discovered the business had failed to comply with the notice.

Tubs of chicken liver had also been left to defrost in the cellar, contrary to the procedures listed in the food safety management system.

The council’s head of public protection, Alun Billinghurst, said: “The premises were found to be in a poor state of cleanliness, the equipment was dirty and food had not been stored at the correct temperature to prevent the growth of bacteria which cause food poisoning. A refrigerator containing food was running at 15.4°C, which is within the danger zone.

“Food safety management procedures were clearly not being followed in terms of cleaning and food storage.

“Our officer ordered a thorough deep clean of the premises, but the business failed to do so.”

The prosecution case for the Barley Mow Inn (Cuisine Inns Ltd) was heard in Cardiff Magistrates Court on 7 February 2013.

The business was fined £3,000 for six food hygiene offences, ordered to pay £500 costs and £15 victim surcharge.

The six offences were:

  1. Failure to comply with a Hygiene Improvement Notice (for cleaning the premises), thereby contravening Food Hygiene (Wales) Regulations 2006 Regulation 6 (2)
  2. Failure to maintain a food business in a clean condition thereby contravening Regulation (EC) No 852/2004 Annex II Chapter I Para.1
  3. Failure to maintain articles, fittings and equipment in a clean condition thereby contravening Regulation (EC) No 852/2004 Annex II Chapter V Para.1 (a)
  4. Failure to store food at the correct temperature which might result in a risk to health, thereby contravening Regulation (EC) No 852/2004 Annex II Chapter IX Para. 5
  5. Failure to thaw food in such a way as to minimise the risk of pathogenic micro-organisms or the formation of toxins in the food thereby contravening Regulation (EC) No 852/2004 Annex II Chapter IX Para. 7
  6. Failure to implement procedures based on the Hazard Analysis Critical Control Point principles, thereby contravening Regulation (EC) No 852/2004 Article 5 Para 2(d).
