A Leicestershire man has been fined £5,000 for operating a skip hire business without a permit.

Overview
The Environment Agency (EA) reported that Mr Thomas Edward Neal (a sole trader) ran a skip hire business trading as ‘Dusty Bins Skip Hire’.

EA officers visited New Hayes Farm on 8 September 2010 following an anonymous report of illegal waste activities taking place. The officers saw evidence of waste materials being sorted and stored on site. Observations included:

  • a number of skip containers in the name of ‘Dusty Bins Skip Hire’, which contained mixed amounts of household and commercial type wastes.
  • amounts of contaminated brick and concrete rubble which had been levelled out to form roadways.
  • a crusher that was being used to crush brick, rubble and concrete.

There was no environmental permit in place to authorise any of these activities.

EA officers made two further visits where they found that the waste had gradually been removed. Mr Neal was able to provide copies of waste transfer notes that confirmed that all the waste had been lawfully disposed of.

Outcome
Mr Neal was charge with breaching Regulation 12(1) and 38(1)(a) of the Environmental Permitting (England & Wales) Regulations 2010 for operated a regulated facility when there was no environmental permit in force.

The court fined Mr Neal £5,000 and ordered him to pay costs of £2,290.84 and a £15 victim surcharge.
