A husband and wife from South Harrow have been fined almost £3,000 for causing a noise nuisance with a tumble dryer.

In what is believed to be the first case of its kind, Brent Magistrates heard how Dereck, and Arlene Brown, used their defective tumble dryer at all times of the day and late evening plaguing people in the flat below.

The court heard from one neighbour who was kept awake at night by rumbling and shaking at their Parkfield Road home.

Harrow Council’s environmental health officers investigated the complaints and found the machine was causing a statutory nuisance. They initially advised the Browns to either fix or replace the machine but no action was taken and the couple were served with an Abatement Notice to stop the problem.

When the couple again failed to take action and the noise continued, the Council had no option but to resort to prosecution.

The Browns were found guilty of breaching the Abatement Notice during a hearing on 11th July, and hit with fines and costs totaling £2,900.

Cllr Phillip O’Dell, portfolio holder for environment and community safety on Harrow Council, said:

“Everyone has the right to peace and quiet in their own home and we gave the Brown’s every opportunity to sort out this problem sensibly.

“It’s sad that we had to resort to court action but the couple left us no alternative as they were making their neighbours’ lives a misery.”
