A landlord and property owner were fined a total of £5,000, plus £660 costs and a victim surcharge of £30, for failing to comply with an improvement notice, under s30 of the Housing Act 2004.

The case at Stockport Magistrates Court on the 17th August 2011, was proved in the absence of landlord Arfan Sardar and property owner Firdous Sardar of Barlow Moor Road, Manchester.
In November 2010, Stockport Council received a complaint from an elderly tenant concerning several issues of disrepair at her privately rented property on Queens Drive in Heaton Mersey.
An investigation by a Council Environmental Health Officer revealed that the property had a faulty heating system which left the tenant incapable of heating her property.
An improvement notice was served requiring the necessary works to be carried out. When the landlord failed to undertake the required works, the Council had no option but to carry out the works in default.
Arfan Sardar and Firdous Sardar were ordered to pay the fine, costs and victim surcharge in the next 28 days.
Councillor Mark Weldon, Executive Member for Communities, said: “This case sends out a very strong message to rogue landlords in Stockport who don’t maintain their properties properly and leave tenants to put up with poor living conditions which impacts on their physical and mental wellbeing.
“Stockport Council will continue to take immediate action against any landlord who puts their tenants’ health at risk.”
