Croydon Council prosecuted Croydon Kebabs Ltd and Mr Alparslan Targan (as the Food Business Operator) for poor conditions and operations at the Croydon Kebab Centre (Photo Gallery Below).

On the 21st March 2011, Mr Kishore Briggs, a Food Safety Officer employed by Croydon Council, visited the Croydon Kebab Centre to carry out a routine Food Hygiene Inspection. On inspection, the conditions and operations were found to be unsatisfactory. Food stored in the walk in freezer was recorded at a temperature of -4°C, which should normally be -18°C. The floors and walls were dirty and the double door fridge next to the freezer was also filthy. A substantial build up of dirt, grease and grime could be seen on equipment, walls and floors.The temperature of the food in the chilled display unit was 17°C when it should have been 8°C or less.
Mr Alparslan Targan had been given ample opportunities to maintain his business at an acceptable standard. He had been given guidance and training from Food Safety Officers and the Safer Food Better Business course and had consistently failed in his responsibilities as a Food Business Operator.
The offences were failure to keep premises clean and in good repair and order, failure to implement and maintain a food safety management system and failure to keep clean and in good repair equipment with which food came into contact with. An additional charge applied for Mr Alparslan Targan, in that he failed to comply with a Hygiene Improvement Notice. The defence asked for the fine to be lessened because all of the remedial works have since been carried out. However, the District Judge said that the repairs carried out only brought the place up to the acceptable standard, and a health hazard quite clearly existed before the repairs were done.
Croydon Kebabs Ltd and Mr Alparslan Targan pleaded guilty to all charges. The District Judge fined them £750 per offence and awarded full costs to the London Borough of Croydon. The breakdown is as follows:
Croydon Kebabs Ltd: £750 x 3 = £2250 Costs: £963 + £15 victim surcharge = £978
Mr Alparslan Targan: £750 x 4 = £3000 Costs: £963 + £15 victim surcharge = £978
Total fine: £5250 and Total Costs: £1956 = Total of £7206
