Dr Michael Bull (Odour Consultant) has provided a summary of the recent appeal decision which considered how many odour complaints made an appropriate threshold for a nuisance claim. The judge decided that there should be consideration of “what people had to put up with” and also stated that there was no general rule requiring a threshold of complaints in nuisance cases. A MIDDLESBROUGH man has been fined and ordered to pay a hefty bill for a second time for the repeated illegal dumping of waste at the same location.
Opinion: Barr vs Biffa Part 2
In April 2011 a judgement was given on a case regarding alleged odour nuisance between 2004 and 2009 from the Biffa waste site at Ware in Hertfordshire. An action group of 152 households brought forward the case with 30 households being selected as lead claimants to bring forward the action. In this case, the judge ruled in favour of Biffa. Health & Safety: Tesco to pay over £59,000 for two serious accidents
The action follows investigations of 2 serious accidents at the Tesco’s Beaumont Leys Store. The first involved a member of the public (Angela Pownall) being hit whilst shopping in the store, by a pallet truck that was being pulled by a Tesco’s employee. The second involved the main entrance door to the Petrol Filling Station collapsing on a Tesco’s employee (Linda Porter) when she opening up at the start of day. (Photos on Flickr)
Health & Safety: Window-cleaning firm fined £65,000 after worker fell through skylight
At Southend Magistrates Court on Monday 5th March, Central Window Cleaning Company Ltd, admitted four health and safety offences in relation to the incident.
Health & Safety: Sheffield company fined £80,000 after worker’s tragic fall
A Sheffield company has been fined following the tragic death of a workman. IDS Logistics UK Ltd on Kettlebridge Road, Darnall were fined a total of £80,000 after pleading guilty to four offences of breaching health and safety legislation at Sheffield Magistrates Court.

Housing: Housing Association fined over dangerous property
Isaac Odeniran, 44, of Parkmead, Loughton, who is the Director of Abundant Life Housing Association, was fined £4,000 and ordered to pay more than £4,000 costs and a £15 victim surcharge for failing to comply with an Improvement Notice for major repairs at a flat.

Public Health: More than 9,000 TB cases reported in 2011
Provisional figures released today by the Health Protection Agency (HPA) show there were 9,042 new cases of tuberculosis (TB) in the UK in 2011. Compared to provisional numbers reported in 2010 (8,587), this is a five per cent increase.

This case involves an Appeal against a demand for the recovery of expenses. The Appeal relates to London Borough of Barnet and them wanting to recover £9,688.51 after taking emergency remedial action on the property.
The London panel confirmed the demand for recovery of expenses.
