A private landlord has been fined £2000 by magistrates after Rugby Borough Council took enforcement action.

He was also ordered to pay the council’s costs of £945.50, and a victim surcharge of £15.

Rugby Borough Council brought the prosecution against Winston Alphonso Davis of 33 Glazebrook Road Leicester, who is landlord of a property on Norman Road, Newbold.

On inspecting this property, environmental health officers discovered very poor living conditions and very poor management practices. The end of terrace property is a house of multiple occupation with three bedrooms, a shared bathroom and kitchen. When inspected it had nine tenants including a couple with a toddler, each paying rent weekly in cash.

Magistrates heard how Mr Davis had failed to comply with an overcrowding notice in respect of a house in multiple occupation served under section 139 of the Housing Act 2004. The notice served required the number of tenants to be reduced from nine tenants to a maximum of five.

The also heard how he had failed to provide information about the ownership, management and occupancy of the property.

Mr Davis had failed to provide information to the occupiers, failed to take safety measures, failed to supply and maintain gas and electricity and failed to maintain common parts, fixtures, fittings and appliances, under the Management of Houses in Multiple Occupation (England) Regulations 2006.

Councillor Leigh Hunt, Sustainable and Inclusive Communities Portfolio Holder said: “This is an example of an unscrupulous landlord, and people like this damage the reputation of other, good private landlords.

“To ensure that the health and safety of tenants throughout the borough is not put at risk, we intend to follow up other cases where landlords have failed in their duty to provide a decent level of accommodation.”
