Hull City Council’s Environmental Neighbourhood Nuisance Team have prosecuted a business for burning commercial waste and causing dark smoke.

Mr Garrison, Managing Director of Caspian Access and Plant Hire Limited, on Cleveland Street, Hull, attended court on the 8 February 2013, in order to answer charges of one offence under the Clean Air Act 1993 and two offences under the Environmental Protection Act 1990.

Officers had attended at Caspian Access and Plant Hire Ltd on the 12 July 2012 after witnessing smoke rising from a fire at the rear of the premises. Officers spoke to staff on site who took them to see the fire which had begun to emit thick black smoke into the air.

Staff admitted to officers that they were burning waste, rather than paying for the waste to be disposed of in a proper and legal manner.

At Hull Magistrates Court on 8 February 2013, Caspian Access and Plant Hire Ltd were found guilty on all charges.

Hull Magistrates Court imposed a fine of £500, £250 prosecution costs and a £15 victim surcharge, totalling £765.

Councillor John Hewitt, Portfolio Holder for Neighbourhoods and Communities, said:

“The Council continues to carry out regular patrols to identify any environmental offences such as commercial burning, littering and fly tipping. All businesses have a duty of care to keep their commercial waste safe and to ensure it is disposed of safely.”
