Following complaints of loud music and raised voices from 46 Kings Bench Street, a noise abatement notice was served on Mr Denton the occupier, by the Council’s Environmental Regulation Section.

Mr. Denton breached the abatement notice on three occasions over a period of 6 months between January 2013 and June 2013 and further written and verbal warnings were ignored.

A magistrate’s warrant was obtained by officers of the Environmental Regulation Section and a music centre and two speakers were seized from the property on 14 June 2013.

On 2 August 2013, having failed to appear at court, Mr Denton was found guilty in his absence of breaching the notice on three occasions and was fined the sum of £400 and ordered to pay a victim surcharge of £25 and costs of £1200.

Councillor John Hewitt, Portfolio Holder for Neighbourhoods and Communities said:

“Residents have a responsibility to live in their property without causing nuisance to other residents.

“Excessive noise can cause distress to neighbours and communities and the council is committed to dealing with anyone that causes noise problems.”
