A Bilborough man was ordered to pay £906.50 last month after pleading guilty to fly tipping under Section 33 of the Environmental Protection Act 1990.

Mr Jason Renner, 22, attended a hearing at Nottingham Magistrates Court on Friday 21st March 2014.

Mr Renner illegally disposed of two large builders’ bags containing a large quantity of domestic and garden waste onto land at Apollo Drive, Nuthall. Mr Renner had been instructed by a friend to collect the waste from a property and dispose of it. Mr Renner had collected the waste and then drove to Nuthall, where he illegally deposited the waste on the land at the end of a residential area.

As a result of his successful prosecution Mr Renner was ordered to pay a total £906.50.

When a person uses a third party to remove their waste they have a legal duty to ensure that their waste is being passed to a licensed waste carrier and that their waste will be disposed of at a licenced site. Should waste be collected without the proper checks being undertaken and the waste is subsequently fly tipped then as the producer of the waste, a person may be liable for prosecution for failing their duty of care.

Councillor Richard Robinson, Portfolio Holder for Environment at Broxtowe Borough Council said:

“The Council takes fly tipping seriously as it can harm the local area, as well as being costly for the Council to remove.”
