The owner of an Indian restaurant in Lea Marston, Mr Lutfur Rahman, has been fined £981 at Nuneaton Magistrates Court for using an unauthorised waste carrier to dispose of his rubbish.

In July last year, the Borough Council’s Rapid Response Team was called out to Haunch Lane in Lea Marston to collect some flytipped waste. They discovered around 40 rotting and stinking bags of rubbish including curries, meats, drink tins, bottles and packaging. As they cleared the bags, some split open to reveal menus and an invoice for The Pavillion Restaurant in Lea Marston. On further investigation, Senior Pollution Control Officer Dean Walters discovered similar rubbish on the restaurant premises.
Mr Rahman was interviewed under caution at the Borough Council and admitted that he had allowed Mr Mohammed Shafiq of Birmingham to take the bags of waste away in his van. Mr Rahman failed to check whether Mr Shafiq was an authorised waste carrier with the relevant paperwork from the Environment Agency. When interviewed subsequently, Mr Shafiq admitted he had left the waste near to the restaurant on Haunch Lane.
Assistant Chief Executive and Solicitor to the Council, Steve Maxey said:
” Clearing flytipped rubbish and litter costs us and the Council Tax payers of North Warwickshire around £650,000 every year – an amount which we could put to much better use to support our services. This court case also sends a very clear message about any business owners’, or indeed residents’, duty of care. It is their responsibility to ensure that their waste is being disposed of correctly and legally and they should check for an official Waste Carriers Licence issued by the Environment Agency. ”
In the second hearing at Nuneaton Magistrates Court, Mr Shafiq was fined £420 after the Court took his reduced circumstances into consideration and his early guilty plea.
