Case 2

  • Fine: £600

Mr Mohammed Iqbal and Mr Gul Bahar of Fairfield Road, Bradford, were charged under the Refuse Disposal (Amenity) Act 1978 and in their absence, a Scarborough Magistrates Court judge fined them each £600, a £60 victim surcharge and £150 costs – a total of £1620 to be paid by them within 14 days.

One of our council officers witnessed the men dumping building waste from a property they were working on at North Marine Road on 15 July 2013. A member of the public also brought it to our attention. The matter was investigated by our Waste Enforcement team but the fly tipping pair refused to get in touch or respond to any request for information. We subsequently removed the waste on public safety grounds.

Steve Reynolds, Environment and Countryside Manager said:

“This prosecution sends a powerful message to anyone who is considering dumping waste. The council takes a zero tolerance approach to all forms of environmental crime and will not hesitate in taking legal action against those persons responsible. Although it is great news that our enforcement team brought Mr Iqbal and Mr Bahar to justice, a considerable amount of time was spent on this enquiry and we ended up having to remove all the illegally dumped waste, a waste of money and resources, which shouldn’t have happened in the first place.”

The Waste Enforcement team advises that anybody needing waste removal services should be careful to check the operator’s credentials and ensure that they get a copy of a waste transfer note when their waste is removed.
