Two London companies have been fined a total of £5,600 for failing to comply with safety orders issued to protect workers from serious injury.

Overview:
The Health and Safety Executive (HSE) reported that Churchill Properties (Southern) Ltd and Moseley Green Services Ltd ignored Prohibition and Improvement Notices, which required statutory examinations to be carried out on a construction site.

A HSE inspector visited Leys Road Oxshott, in Surrey on 19 May 2010 and found construction work underway to the retaining basement walls of two new houses. Churchill Properties were commissioned as the principal contractor for the site, Moseley Green Services were subcontracted to build the foundations.

The inspector found there was a significant risk of the excavation collapsing, or materials from the excavation walls falling and injuring workers. A Prohibition Notice was served by the HSE Inspector to stop work on the site and an Improvement Notice was served a week later for not planning, managing and monitoring the construction phase.

Outcome:
Churchill Properties (Southern) Ltd, of Melbourne Grove, Southwark, pleaded guilty to breaching Regulation 22(1)(a) of the Construction (Design and Management) Regulations 2007. The company was fined £2,800 and ordered to pay costs of £2,917.

Moseley Green Services Ltd, of Woolmer Way, Whitehill, Bordon Hampshire, pleaded guilty to breaching Regulation 31 of the Construction (Design and Management) Regulations 2007. The company was fined £2,800 and ordered to pay costs of £2,917.
