On 29 October 2012 Mr Ian Day and Mr Mark Newton of 41 Walliker Street were served a Statutory Notice served under section 80(1) Environmental Protection Act 1990, contrary to section 80(4) Environmental Protection Act 1990.
The notice was served in relation to a large build-up of household waste that was releasing very strong odours. This prompted nearby residents to contact the council.
After failing to comply, Hull Magistrates ordered each of them to pay fines of £400, costs of £200 and a £20 victim surcharge on 17 December 2012.
Justine Mortimer, Neighbourhood Nuisance Manager said:
“The Council was made aware of a significant build up of waste items in the rear yard of a property on Walliker Street that had been empty for some time.
“Despite formal and informal attempts to contact Mr Day and Mr Newton at their address via different means, they failed to engage with the Council at any stage. Consequently they were serviced a legal notice which was not complied with and the property was cleared by the Council.
“We would encourage residents to report any incidents of this kind in order for us to tackle environmental crime”.
