Hull City Council has successfully prosecuted a local business for fly tipping. A and J Clubb Limited (also known as Relax Nightclub) of 25 Spring Bank West, Hull were prosecuted at Hull Magistrates Court for four offences under section 34 of the Environmental protection Act 1990.

They were ordered to pay £500 fine, £600 costs and £20 victim surcharge for failing to ensure their waste was removed and disposed of by a person authorised to do so.
The prosecution was brought about after an investigation by the Neighbourhood Nuisance team, relating to fly tips at two locations (Cecil Street and Greek Street) in September 2012 that both contained evidence relating to the business.
Upon being interviewed, a representative of the business stated that the business had recently paid an unknown male to remove waste from their premises and this must be how the waste had ended up fly tipped.
Councillor John Hewitt, Portfolio Holder for Neighbourhoods and Communities said:
“It is imperative that all businesses have lawful waste management practices in place to comply with their duty of care in accordance with the Environmental Protection Act 1990.
“This not only ensures that they are acting responsibly within the legislation but also removes the opportunity for less scrupulous people to remove waste and dispose of it irresponsibly, as happened in this instance”.
