A man prosecuted for repeatedly leaving his recycling out on the wrong day and blighting his neighbourhood has failed in his appeal to have his prosecution overturned.
Mr Leslie Brooks’, aged 48 of Lower Street, Basildon, appeal against his conviction and sentencing for putting recycling sacks out on the wrong day was heard in Basildon Crown Court and dismissed by a Judge and two Justices (30 June).
Mr Brooks was originally prosecuted in January 2011 but did not attend Basildon Magistrates Court so the matter was proven in his absence and he was fined £75 and ordered to pay costs of £150 and a victim surcharge of £15.
Councillor Malcolm Buckley, Basildon Council’s Cabinet Member for Environment, said:
“I am very pleased that the courts have supported our original decision to prosecute.
“There is no good reason why pink recycling sacks were repeatedly put out on the wrong day.
“Recycling bags should be put out only on the day of collection.
“If they are left out for days on end, as happened in this case, it can anger other residents who want to keep their community clean and tidy.
“Indeed, it is often neighbours who report these matters and ask the Council to take action.
“Residents, like Mr Brooks, need to remember they are part of a community and should consider the impact of their actions on their neighbours.”
