The judge summarised that Iceland did in fact fail in their recall procedure for two reasons.

  • Firstly, The Store Manager failed to check the stock properly and also failed to enter the details in the Food Legislation Folder as per the company procedure.
  • Secondly, the Area Manager also failed because he/she did not pick up on the fact that the Store Manager had failed to make the entry into the Food Legislation Folder.

Both these checks failed which resulted in the ready meal being allowed to be sold to Mr Driver. The judge also stated that the offence was brought about because the chicken in the meal was partly or wholly raw which in itself could be considered as unfit for human consumption.

Iceland were fined £20,000 and ordered to pay £5,500 in costs.
