On 2 September, an Enforcement Officer from the Council’s Community Safety and Civil Protection team responded to a report about a huge pile of rubbish including a bath, broken tiles and carpet flytipped in Frederick Street Passage.  Council officers traced the rubbish to a Barton Road property. Further investigation revealed Owen Ayres, operating as Owen’s Clearance Services, was paid by a builder working at the property to remove the waste.

On 19 November, a Council Enforcement Officer responded to a report about a huge quantity of rubbish including wooden doors, carpet, tyres and rubble flytipped in the Parys Road garage site.  Further investigation again linked it to Owen Ayres.

During sentencing, Magistrates said Ayres had left: “…a disgusting mess and the message needs to get out there that this is not acceptable”.

After pleading not guilty at a first hearing, Ayres admitting to illegally depositing waste at both locations.  Magistrates found him guilty under Section 33 of the Environmental Protection Act 1990.  He received a 12 month Community Sentence with 120 hours of unpaid community work and full costs of £1,800.

Cllr Dave Tayor, portfolio holder for the environment, said:  “If you spot someone fly tipping, we need to know about it to put a stop to it. We will always take legal action if there is enough suitable evidence.  soLUTiONs, Luton’s Community Safety Partnership, also supports all enforcement measures to tackle this type of antisocial activity which is a real blight on communities.”
