Basildon Council has snagged another food prosecution after a mobile trailer was fined over £8000 for a number of offences, including having food fourteen days past its sell by date in the fridge (Photos on Flickr).

Davat Dalman, 47, of Tillottson Road, Edmonton, Middlesex, ran the ‘Porky’s’ mobile trailer in Harvey Road, Basildon and was ordered to pay a total of £8112.50 at Southend Magistrates Court on 20th February 2012

Basildon Council’s environmental health officers visited the premises on 16 February 2011 and found a lack of food safety management and a failure to have suitable procedures for keeping food safe.

Other offences were also found including:

  • Failure to keep the trailer clean
  • Failure to keep food at a suitable temperature potentially allowing bacterial growth
  • Inadequate supervision, instruction or training for staff
  • Having food beyond the ‘use by’ date in the refrigerator – ham dated 2nd February 2011 (14 days old) and black pudding dated 3rd February 2011 (13 days old)

Mr Dalman was fined a total of £4900 and ordered to pay £3197.50 towards the costs of the case.

Cllr Richard Moore, cabinet member for planning (and with responsibility for food safety), said:  ”There is quite rightfully a basic expectation that those in the catering business, whether they run a restaurant or a mobile trailer meet minimum standards of food hygiene and safety.  To have food in the fridge that is two weeks out of date is simply unacceptable and I am pleased that our officers have secured a successful prosecution.

“We have seen a rise in the number of prosecutions of food businesses across the borough and this is another example of our environmental health team taking to task those not willing to meet basic standards of hygiene.

“This is not about local government interference or bureaucracy, it is about ensuring the residents and visitors to our borough can get a meal or takeaway that is safe and properly prepared.  To not meet these basic standards is both dangerous and unacceptable.

“I hope that the outcome of this case sends a clear message that Basildon Council will take action against those businesses that are prepared to put our residents at risk.”
