A MIDDLESBROUGH man has been fined and ordered to pay a hefty bill for a second time for the repeated illegal dumping of waste at the same location.

Fidel Da Silva was convicted in his absence at Teesside Magistrates’ Court of breaching the Environmental Protection Act.

The court case followed his conviction last year for the same offence which followed numerous complaints about the dumping of waste on the rooftops of derelict garages to the rear of Rochester Road, Middlesbrough.

At this time action was also taken over the dumping of waste including broken asbestos sheets, builder’s rubble, guttering and household items in a garage compound area to the rear of Burlam Road.

Da Silva, of Burlam Road, Middlesbrough, subsequently admitted three charges and was fined £100 for each with a victim surcharge of £15 and costs of £2,050.09 when he appeared in court last July.

He was charged with similar offences on Tuesday, March 6 after further waste was discovered in the same location, but failed to attend court last week after requesting a two-week adjournment.

He was unrepresented despite seeking a further adjournment to instruct a solicitor at last week’s hearing. The case was heard in his absence and he was fined £435 and ordered to pay a £15 victim surcharge and costs of £850 including the cost of removing the waste.

Councillor Julia Rostron, Middlesbrough Council’s Executive Member for Community Protection said: “Mr Da Silva has shown  blatant and repeated disregard for the law, and that has left him with a hefty fine and costs bill which could easily have been avoided.

“Waste disposal laws are there to ensure that potentially hazardous material is dealt with safely and with the protection of the public in mind.

“We are always happy to offer guidance, but will not hesitate to take action against those who break the law.”
