Luton Council has successfully prosecuted Farooq Hussein, owner of Express News, 8 High Town Road in Luton LU2 0DD, under Section 34 of the Environmental Protection Act (EPA) 1990.

After Council Enforcement Officers carried out a routine inspection of Express News last July, Hussein was asked to provide documentation to show how his business had been disposing of its waste.  When he failed to produce appropriate waste transfer paperwork, he was served a Fixed Penalty Notice which he then failed to pay.

At Luton Magistrates Court on 30 April, Hussein pleaded guilty to failing to provide proper waste transfer notes for his business waste.

Magistrates fined Hussein £300 + a £15 victim surcharge and ordered him to pay £300 towards the prosecution costs, alongside a Collection Order of £615.

Cllr Dave Taylor, portfolio holder for the environment, said:  “The law surrounding the disposal of business waste is to stop our streets and countryside filling up with unsightly rubbish, much of which is potentially dangerous and even toxic.  Breaking the law is antisocial and potentially damaging to both flora and fauna.”
