The owner of Wervin Mobile Home Park has pleaded guilty at Chester Magistrates Court for failing to comply with two site licence conditions.

James Ithell admitted breaching two conditions imposed under the Caravan Sites and Control of Development Act 1960; one relating to onsite electrical safety and one relating to boundary fence height between caravans.

Mr Ithell aged 52 from Wervin Road, Wervin, was fined £500 for the two offences and ordered to pay £800 towards prosecution costs.

Cheshire West and Chester Council’s Consumer Protection and Investigations Team brought the prosecution after Mr Ithell failed to employ a competently trained electrician to undertake works on the Park and allowed a fence to be extended above the one metre height stated level for protecting the fire safety of residents.

Councillor Lynn Riley, Executive Member for Community and Environment, said: “We have worked extensively with the owner to try to achieve a safe, compliant, well managed site and this action was taken as a last resort.

“It is the Council’s hope that all caravan site owners will learn from this court case action and appoint a quality, competent professional to do site works and take a proactive approach to managing fire safety. This will also have the benefit of creating a safe and healthy environment for site residents.

“The Council is visiting all caravan sites across the Borough over a four year period to encourage good standards of management and licence compliance.

“This is of particular importance since many sites are occupied by elderly or vulnerable residents.

“The Council has a duty to issue caravan site licences to all of them within the Borough providing that the applicant has valid planning permission.

“Site Licence conditions are designed to protect the health, safety and welfare of caravan occupants and cover such issues as Fire Safety, Electrical Safety, Water Supply and Drainage Sanitation”.
