Four people in a shared house in Hart Place, Splott, Cardiff were fined a total of £1065 for breaching a Noise Abatement Notice under Section 80 of the Environmental Protection Act 1990.

The four had been visited by the Council’s duty night noise officers several times over the course of a month following a number of complaints from neighbours. The officers witnessed sufficient amplified music to establish at least two breaches of the Abatement Notice. As a result, a warrant was obtained and a seizure carried out during which 8 items were removed, including; speakers, DVD players, CD player and a laptop.
Miss Edyta Buczynska pleaded guilty to 2 offences and was fined £135 and ordered to pay costs of £100 as well as a victim surcharge of £15.
Mr Krzysztof Orzechowski pleaded guilty to the 1 offence and was fined £65; ordered to pay costs of £50 and a victim surcharge of £15.
Mr Radek Jablonski also pleaded guilty to the 1 offence and was fined £65; ordered to pay costs of £50 and a victim surcharge of £15.
The case against Mr Tomasz Wisineski was proved in his absence. He was fined £400 per offence (total of £800); ordered to pay costs of £100 and a victim surcharge of £15.
A Forfeiture Order was granted against all of their names.
Chair of Cardiff Council’s Public Protection Committee, Cllr Derrick Morgan, said: “We hope these cases will make some residents think twice about causing unacceptable levels of noise. The complaints we receive about noise are taken seriously. We try to deal with problems informally; however, if things are not resolved then we will take enforcement action against the offenders which could include prosecution and seizing their TVs and hi-fis.
