Hull City Council has successfully prosecuted a local business for fly tipping. A and J Clubb Limited (also known as Relax Nightclub) of 25 Spring Bank West, Hull were prosecuted at Hull Magistrates Court for four offences under section 34 of the Environmental protection Act 1990.

A man from Northampton who dumped his rubbish off a main road in Rugby has been ordered to pay £660. In a prosecution brought by Rugby Borough Council, the court was told that Mr Catalin Gheorghiu of 5 Great Gull Crescent, Northampton, was seen throwing rubbish into a bush near the Elliott’s Field retail park on Leicester Road.

On the 28th March 2013 at Merthyr Magistrates Court, Ria Jones, of 7 Lupin Close, Gurnos Estate, Merthyr Tydfil pleaded guilty to breaching a Noise Abatement Notice served by Merthyr Tydfil CBC Environmental Health Service. During the investigation Ms Jones had various electronic equipment seized by the Council.

A Hendy man and Swansea company have been convicted in court for two waste offences. Peter Karl Davies and Purnell Construction Ltd pleaded guilty at Carmarthen Magistartes Court for carrying waste without a waste carriers licence and for failing to complete waste transfer notes.

In a recent noise enforcement forum questions were raised over the use of unqualified and inexperienced personnel to investigate and make determinations of statutory nuisance on behalf of local authorities. In particular, concerns centred around the possibility of legal challenges on appeal of a notice or during criminal proceedings. This article provides some discussion on some of the issues involved.
