Following a recent prosecution of a struck-off solicitor by Camden Council, we have been provided with a detailed case summary that shows just how complex housing prosecutions can be. This case summary (by consultant Michael Warren) includes advice for officers who are investigating or preparing HIMO prosecutions. Environmental Protection: Food storage company fined for causing nuisance to neighbours
Action by Luton Council against a food storage company causing a nuisance to neighbours has led to a court fine for the owner for breaching a noise abatement notice.

Food Safety: Cafe owner fined for poor hygiene standards
The owner of a Middlesbrough cafe has been fined £3,500 after breaching food hygiene rules. Environmental Health Officers from Middlesbrough Council’s Community Protection Service visited Manolia Shawerma, a cafe on Gresham Road, Middlesbrough in August, 2011 to carry out a routine food hygiene inspection.

Health & Safety: Hammersmith and Fulham prosecuted for gas safety failings
The London Borough of Hammersmith and Fulham has been fined £83,600 for failing to arrange annual safety checks on gas appliances in tenanted accommodation.

A rouge landlord who amassed a property empire by illegally cramming 28 flats into four houses has been prosecuted and fined a total of £320,000.

A landlord has been removed from the landlord register which makes it a criminal offence for him to rent out property – the first time this power has been used in Edinburgh.

This case relates to an Appeal against an Improvement Notice served by Great Yarmouth Borough Council. The Improvement Notice involves Category 1 & 2 hazards such as Excess Cold, food safety and falling elements.
The Eastern Panel awarded costs for the Appellant to pay to the Local Authority due to non compliance with Tribunal Directions and failing to communicate both with the Tribunal and the Local Authority since the appeal was filed.
RPT Decision: Rent Repayment Order (BIR/00CN/HMA/2012/0003, BIR/00CN/HMA/2012/0006 & BIR/00CN/HMA/2012/0005)

This case relates to an Application for a Rent Repayment Order made by 3 Tenants of the same property. The Midland Panel ordered the Respondent to pay the Tenants a total of £1,600.
